1. Acceptance of Terms

By creating an account or using iCAR3 at icar3.com, you agree to these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

iCAR3 is a communication platform that allows registered users to send and receive messages associated with vehicle license plates. The service includes SMS notifications, WhatsApp notifications, anonymous tip reporting, and in-app messaging.

3. SMS Messaging Terms

By providing your phone number and enabling SMS alerts, you agree to receive text notifications from iCAR3 regarding messages sent to your registered license plate.

5. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Each license plate may only be registered to one account at a time.

6. Anonymous Tips

Anonymous tips are intended for reporting legitimate safety and traffic incidents. Submitting false tips or using the tip feature to harass vehicle owners is strictly prohibited and may result in account termination. Your identity is logged internally with each tip for accountability purposes.

7. User-Generated Content & No Responsibility for Messages

iCAR3 is a passive conduit for messages between users. We do not author, monitor, endorse, verify, or pre-screen any message, photo, tip, or other content sent through the platform. All content is the sole responsibility of the user who submitted it. iCAR3 is not liable for any content sent by users, including content that is harassing, defamatory, false, offensive, infringing, or unlawful. Consistent with 47 U.S.C. § 230, iCAR3 is not the publisher or speaker of user-submitted content. If you receive a message you believe violates these Terms, report it to support@icar3.com and we will review.

8. Harassment, Threats, and Cooperation with Authorities

Harassment, threats, stalking, doxxing, hate speech, and abusive messaging are strictly prohibited and grounds for immediate account termination and permanent ban. We cooperate with valid law-enforcement requests and may disclose user identity, contact information, and message history pursuant to a subpoena, court order, or other lawful process, or where we believe in good faith that disclosure is necessary to prevent imminent harm.

9. Indemnification

You agree to defend, indemnify, and hold harmless iCAR3, its operators, owners, officers, employees, and agents from any claim, demand, loss, liability, damage, fine, penalty, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) any content you submit, send, or transmit; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party; or (e) any dispute between you and another user.

10. Disclaimer of Warranties

iCAR3 is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted service. We do not guarantee message delivery, notification timeliness, identity of senders or recipients, or that the service will be free of errors or harmful components. SMS delivery depends on carrier availability and A2P registration status.

11. Limitation of Liability

To the maximum extent permitted by law, iCAR3 and its operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the service, including delayed or undelivered notifications in emergency situations. Our total aggregate liability for any claim arising from these Terms or the service shall not exceed one hundred US dollars (US$100). Users should always contact emergency services directly in life-threatening situations.

12. Binding Arbitration & Class-Action Waiver

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the iCAR3 service shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in the State of New York, in English. You and iCAR3 waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative action. Claims must be brought in your individual capacity only. You may opt out of this arbitration agreement by emailing support@icar3.com within 30 days of first accepting these Terms. Notwithstanding the foregoing, either party may bring an individual action in small-claims court.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Subject to the arbitration clause above, the exclusive venue for any permitted court action is the state or federal courts located in New York County, New York.

14. Termination

We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion and without notice. You may delete your account at any time by contacting support@icar3.com.

15. Changes to Terms

We may update these terms periodically. Continued use of iCAR3 after changes constitutes acceptance of the updated terms.

16. Intellectual Property — Patent Pending

The iCAR3 platform, including its plate-to-plate messaging methods, recipient-resolution and multi-channel dispatch systems, and QR-based driver-contact workflows, is protected by U.S. patent application No. 19/702,956 (filed June 9, 2026). Patent Pending. All rights reserved.
